The license issued to you by Broadway Square Partners, LLP (owners of the parking structure, “BSP”) allows you to park one vehicle in the parking garage at your sole risk. The license issued to you may not be assigned or transferred by you in any respect, and may not be shared with any other person or party.
The Kansas City Southern Railway Company (“KCSR”), BSP, and Mid-Con Management LLC (operator of the parking structure, “MCM”) does not guard or assume care, custody or control of you, your vehicle or your vehicle’s contents. By executing this agreement, you acknowledge and agree that none of KCSR, BSP, or MCM shall be responsible or liable for any death or injury suffered by you, or for the loss, theft or damage to vehicles or vehicle contents. Each vehicle is parked at the owner’s and/or operator’s risk.
This agreement and the license, as applicable, issued to you may be cancelled and/or terminated at any time by KCSR, BSP, or MCM.
Parking is paid on a semi-monthly basis (rates are subject to change without notice) and will be deducted pre-tax from your pay. By executing this agreement you authorize KCSR to withhold such amounts from your pay.
A $20 fee (subject to change without notice) will be charged for replacement transponders.
Employees who are off work are still required to pay for parking unless arrangements have been made to end parking. Please access the Kansas City Southern Parking portal to end and restart your parking privilege.
No allowance is made for billed time not used.
Vehicles may not be stored for an extended amount of time without the prior written approval of MCM. Your vehicle must be moved at least once per week.
During your use of the parking structure, you agree to comply with all applicable laws, rules, regulations, and ordinances.
NONE OF KCSR, BSP, AND MCM MAKES ANY REPRESENTATION OR WARRANTY AS TO THE SUITABILITY OF THE PARKING STRUCTURE FOR YOUR INTENDED PURPOSE OR OTHERWISE. YOU AGREE AND ACKNOWLEDGE THAT YOU HAVE INSPECTED THE PARKING STRUCTURE AND TAKE THE FACILITY “AS IS”, RENOUNCING ALL WARRANTY OF KCSR AND/OR MCM AS TO SUITABILITY OF THE PARKING STRUCTURE FOR YOUR INTENDED PURPOSE OR OTHERWISE, NOW OR HEREAFTER.
Your signature of this agreement acknowledges that you have read and understand the terms and conditions of this agreement. There are no outside conditions, warranties, verbal agreements or understandings.
Any electronic or digital signature (including any electronic symbol or process attached to, or associated with, a contract or other record and adopted by a person with the intent to sign, authenticate or accept such contract or record) to this Agreement shall have the same legal validity and enforceability as a manually executed signature or use of a paper-based recordkeeping system to the fullest extent permitted by applicable law, including the Federal Electronic Signatures in Global and National Commerce Act, or any state law including those based on the Uniform Electronic Transactions Act, and the parties hereby waive any objection to the contrary.
